AllAnswered (the “Company”) is committed to maintaining robust privacy protections for its users.  Our Privacy Policy (“Privacy Policy”) is designed to help you understand how we collect, use and safeguard the information you provide to us and to assist you in making informed decisions when using our Service. We are compliant with General Data Protection Regulation (GDPR) and California Consumer Privacy Act (CCPA).

For purposes of this Agreement, “Service” refers to the Company’s service which can be accessed via our website located at allanswered.com as well as any other media form, media channel, subdomains, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).  The terms “we,” “us,” and “our” refer to the Company. “You” refers to you, as a user of Service. If you are registering for or using the Services on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these Terms. In that case, "you" and "your" will also refer to that organization, wherever possible.

I.               INFORMATION WE COLLECT

We collect “Non-Personal Information” and “Personal Information.”  Non-Personal Information includes information that cannot be used to personally identify you, such as anonymous usage data, general demographic information we may collect, referring/exit pages and URLs, platform types, preferences you submit and preferences that are generated based on the data you submit and number of clicks.  Personal Information includes your email, name, profile picture, as well as any other information with which you choose to provide us.

  • Information collected via Technology

In an effort to improve the quality of the Service, we track information provided to us by your browser or by our software application when you view or use the Service, such as the website you came from (known as the “referring URL”), the type of browser you use, the device from which you connected to the Service, the time and date of access, and other information that does not personally identify you.  We track this information using cookies, or small text files which include an anonymous unique identifier.  Cookies are sent to a user’s browser from our servers and are stored on the user’s computer hard drive.  Sending a cookie to a user’s browser enables us to collect Non-Personal information about that user and keep a record of the user’s preferences when utilizing our services, both on an individual and aggregate basis.  

  • Information you provide us by registering for an account

In addition to the information provided automatically by your browser when you visit the Site, to become a user to the Service you will need to create an account. You can create an account by registering with the Service and entering your email address, a user name and a password. It is optional that users provide job role, bio information, and profile picture—this information will be collected if provided. By registering, you are authorizing us to collect, store and use your personal information in accordance with this Privacy Policy.

  • Children under 18

We do not knowingly collect or solicit personal information from anyone under the age of 18 or knowingly allow such persons to register with the Service. If we become aware that we have collected personal information from a child under age 18 without verification of parental consent, we take steps to remove that information.

  • Subscription and billing

When purchasing the Services, we will require that you provide financial and billing information, such as billing name and address, and phone number. We do not collect or store your credit card number which is directly handled by Stripe which is PCI compliant.

II.             HOW WE USE AND SHARE INFORMATION

In general, the Personal Information you provide to us is used to manage your access to the Service and to help us communicate with you.  For example, we use Personal Information to contact users in response to questions, provide technical support, and inform users about new features.

We use billing information to check the financial qualifications of prospective customers and to collect payment for the Services. We use Stripe to manage credit card processing and Stripe is not permitted to store, retain, or use Billing Information except for the sole purpose of credit card processing on our behalf.

We do share Personal Information with trusted third-parties who are performing services for the Company, such as the servers for our email communications who are provided access to user’s email address for purposes of sending emails from us.  Those vendors use your Personal Information only at our direction and in accordance with our Privacy Policy.

We shall not sell, transfer or lease out your personal data to third parties.

In general, we use Non-Personal Information to help us improve the Service and customize the user experience.  We also aggregate Non-Personal or non-identifying Information in order to track trends and analyze use patterns on the Site.  This Privacy Policy does not limit in any way our use or disclosure of Non-Personal or non-identifying Information and we reserve the right to use and disclose such Non-Personal or non-identifying Information to third-parties at our discretion.

We will disclose your Personal Information where required to do so by law or subpoena or if we believe that such action is necessary to comply with the law and the reasonable requests of law enforcement or to protect the security or integrity of our Service.

In the event we undergo a business transaction such as a merger, acquisition by another company, or sale of all or a portion of our assets, your Personal Information may be among the assets transferred.  You acknowledge and consent that such transfers may occur and are permitted by this Privacy Policy, and that any acquirer of our assets may continue to process your Personal Information as set forth in this Privacy Policy.  If our information practices change at any time in the future, we will post the policy changes to the Site so that you may opt out of the new information practices.  We suggest that you check the Site periodically if you are concerned about how your information is used.

III.           HOW WE PROTECT INFORMATION

The security of your Personal Information is important to us. We implement security measures designed to protect your information from unauthorized access.  Your account is protected by your account password and we urge you to take steps to keep your personal information safe by not disclosing your password and by logging out of your account after each use. Furthermore, you are responsible for maintaining the security of any personal computing device on which you utilize the Services. We further protect your information from potential security breaches by implementing certain technological security measures including encryption, firewalls and secure socket layer technology.

IV.          RETENTION

We will keep your Personal Information only for as long as it remains necessary for the purposes set forth in this Privacy Policy, which may extend beyond the termination of our relationship with you. We will retain and use your Personal Information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. All retained Personal Information will remain subject to the terms of this Privacy Policy.

VI.           DATA PRIVACY FRAMEWORK CERTIFICATION

We have certified to the Department of Commerce that we adhere to the Data Privacy Framework Principles (“Principles”) of the EU-U.S. Data Privacy Framework, the UK Extension to the EU-U.S. Data Privacy Framework, and the Swiss-U.S. Data Privacy Framework. we comply with all its obligations under the Principles. The Federal Trade Commission has jurisdiction over our compliance with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF).

In compliance with the Principles under Data Privacy Framework, as well as the GDPR, we will process data subject requests (as directed by the customer or “data controller”) and resolve complaints about our collection or use of personal information. EU and Swiss individuals with inquiries or complaints relative to our data collection should contact: support@allanswered.com.

We have further committed to refer unresolved privacy complaints to JAMS, an alternative dispute resolution provider based in the United States. If you do not receive timely acknowledgment of your DPF Principles-related complaint from us, or if we have not addressed your DPF Principles-related complaint to your satisfaction, please visit https://www.jamsadr.com/DPF-Dispute-Resolution for more information or to file a complaint. The services of JAMS are provided at no cost to you.

If your complaint cannot be resolved through the above channels, you may have the possibility to engage in binding arbitration through the Data Privacy Framework Panel. For more information on this option, please see Annex I of the EU-U.S.Data Privacy Framework Principles.

We are responsible for the processing of personal data it receives under the DPF and subsequently transfers to a third party acting as an agent on its behalf.  We comply with the DPF Principles for all onward transfers of personal data from the EU, UK, and Switzerland, including the onward transfer liability provisions.

VII.          CHANGES TO OUR PRIVACY POLICY

The Company reserves the right to change this policy and our Terms of Service at any time.  We will notify you of significant changes to our Privacy Policy by sending a notice to the primary email address specified in your account or by placing a prominent notice on our site.  Significant changes will go into effect 30 days following such notification.  Non-material changes or clarifications will take effect immediately. You should periodically check the Site and this privacy page for updates.
